SUMMARY OF ARGUMENT: ³í°Å ¿ä¾à
The sexual abuse misdemeanor charge filed against Mr. Yoon, Chang-Joong by Ms. A, as specified in Complaint Report No. 13060903, is groundless and false. Her accusation has cost Yoon, the plaintiff, his job, reputation, and livelihood entirely. The plaintiff plead that her charge against Yoon be dismissed immediately, and that she pays all the expenses incurred related to any and all legal litigations that have happened in the past and also could happen in the future between Yoon and her, regardless of who is the originator of the legal litigation.

The charge as listed in Complaint No. 13060903 is a sexual misdemeanor, and more specifically ¡®Yoon Grabbed her buttocks without her permission¡¯ in the hour between 9 :30 PM and 10 PM of May 7th.

Legally, grabbing buttocks without permission is not necessarily a crime of any sort. For example, a lover grabs the buttocks of his lover without permission without having to fear about a possibility that he could be charged of any crime. Also, it does not constitute a crime if a person grabs buttocks of a companion as an advance gesture so as to measure the level of affinity or affection of the companion toward himself at the particular moment.

It constitutes a legal crime only when the companionat the receiving end of the action makes it genuinely clear, via either verbal utterances or bodily motion, that the action is definitely unwanted, and, when, despite the clear message, the action is repeated.

Here, ¡®genuinely clear¡¯ and ¡®definitely unwanted¡¯ are important because in some cases the person at the receiving end makes verbal or bodily resistance out of shyness or in order to maintain her dignity even though she does not consider the action offensive at that particular moment. Most of the loves and affectionate relations are matured, or terminated, through such an act of tentative advancement and responses thereof.

As witnessed by the chauffe

She is not related to Yoon in any obligatory fashion such as employer-employee relationship or any that sort. Yoon was a temporary visitor from Korea, and Ms. A his guide during Yoon¡¯s stay in D.C. over two days. As such, Ms. A could offer a convenient excuse and end the encounter anytime she wanted. However, she was a willing partner of the encounter in the evening all along. Specifically, the chauffeur is said to witness no unpleasant moment in which Yoon made a bodily advancement only to cause Ms. A to lodge a protest.

It is not clear why Ms. A stated in the complaint that the encounter lasted only about 30 minutes and endedat 10 PM. In order to respect her probable wish that she wants to let the world know that she did not stay with Yoon beyond 10 PM, Yoon also maintained in his public interview thatthe meeting ended at 10 PM after about 30 minutes of chatting over wines. However, the truth is that Ms. Yoon was a willing partner in that evening willing to prolong the encounter to near midnight in a cordial and friendly atmosphere.

Accordingly, one could surmise very safely that there did not exist any intention on the part of Ms. A to lodge a charge against Yoon of sexual misconduct related to the encounter in that evening.

Then Ms. A filed a charge in the following day, claiming that, as specified in the MPS Report 13060903, Yoon had ¡®grabbed her buttocks without her permission¡¯ during the encounter of the previous evening, more specifically between 9:30 PM and 10:00 PM.

This accusation is very absurd in its extreme because Ms. A did not lodge any protest or that sort in the evening, at least to a level that deserves a legal suit. The chauffer did not witness any of such moments. Granted that he did not stay with Ms. A and Yoon all the time in its entirety during the evening, but the durations of the absence were rather scanty and minimal, which means very clearly that the atmosphere between Ms. A and Yoon was far from being hostile or problematic in that evening. The encounter proceeded, and then ended, in a cordial and friendly manner.

In short, Yoon was not offered any chances and opportunities to remedy his behavior if it was indeed sexually offensive to Ms. A. Ms. A filed an afore-mentioned complaint suddenly and out of the blue sky in a very belated hour.

One could even speculate that Ms. A¡¯s intention is to frame Yoon, with an ill-intention of tainting Yoon¡¯s reputation and destroying his career and livelihood. Yoon is the primary spokesman for the president of Korea, Park, Geun-Hye, who was visiting president Obama during the particular days involved with this incident of sexual misconduct accusation. In particular, Yoon, having been a quite hawkish conservative columnist before the appointment by the president to the spokesman position, has been a main target of leftists in Korea, and also in the Korean American communities in USA. He is one of the most hated personalities by the leftists in the Korean political arena.

There are speculations milling around in Korea, and Korean American communities in USA as

There is an accusation that Yoon chose to escape the scene of crime, and departed USA in a big hurry in that afternoon just after the complaint had been filed by Ms. A, and that, by doing so, Yoon acknowledged implicitly his guilt of the crime he is accused of.

This is totally false. Yo
on insisted on staying in D.C. and defend himself as he was not guilty of any crime. However, his superior Mr. Lee, Nam-Gi and his subordinates ganged up together, and ordered and forced Yoon to leave Washington D.C. and USA in that afternoon. Then they fabricated all kinds of rumors that Yoon had made the decision to leave USA on his own, and in doing so, acknowledged his guilt, arranged the departure on his own, made a false excuse that he was leaving because his wife had fallen into sudden sickness, on and on. All these rumors turned out to be false, mostly fabricated by Lee, Nam-Gi and his people

STATEMENT REGARDING LEE, NAM-GI¡¯S FABRICATION RELATED TO THE LEAGAL SUIT BY MS. A:
it is Lee, Nam-Gi, theaide to President Park, Geun-Hye for public relationship (¡®Hongbo Suseok¡¯), who has turned the Yoon¡¯s sex scandal into an unmanageable feeding frenzy. And the victims who have hurt most from his deed areYoon, Chang-Joong, and also the president, and Korea as a nation.
Let¡¯s reconstruct the event:
Yoon, Chang-Joong got on a plane heading back to Korea on the eighth of May immediately after he had found himself engulfed in the sex scandal. As the journey was made in a big hurry, only seat he could find was of the business class.
Lee, Nam-Gi was in a position to know Yoon¡¯s sudden departure as he is the immediate superior of Yoon according to the Blue House official organization system, but it has been found that Lee chose not to report the sexual scandal and Yoon¡¯s departure to the president for 24 hours or longer. Lee told reporters that he had briefed to the president immediately, but this statement of his was found later to be false. Actually Lee had made false statements a few times only to correct them later when the truths turned up.
In particular, Lee did not inform to the president about the incident, leaving the president in the dark completely, even though he was confined in the presidential airplane along with the president over five hours en route from D.C. to LA that afternoon.
On this, Lee has made a series of mumbo-jumbos, but his decision not to inform the president still remains quite baffling beyond anybody¡¯s comprehension. Despite of the fact that the news would become a sizzling hot topic across the world very soon, why did Lee leave the president in the dark during the long and dreary five-hour flight? And, furthermore, he delayed
reporting even further after the flight, alas, to the next day, makingthe incomprehensible delay in reporting cumulatively24 hours or even longer. It would not be possible for Lee to lodge a protest even if people say that he might have a hidden agenda of his own behind the unforgivable and even treacherous act.
And, Lee has claimed all along that it was Yoon who made the decision to leave Washington D.C. in a big hurry (presumably to avoid an impending arrest or the sort, and ultimately to dodge the investigation by the local police). By doing so, Lee made Yoon appear very guilty of the crime he was accused of. It is reasonable to assume that Lee painted Yoon as a genuinely guilty of the charge when he broke the news to the president at a long last. That is, he would have said to the president that "Yoon acknowledged his guilt, and chose to escape to Korea on his own will!", which would be enough to enrage the president so much so that she would order Yoon¡¯s dismissal summarily from his position as the President¡¯s Spokesman.
In summary, it was Lee, Nam-Gi who made Yoon, Chang-Joong as guilty as charged. "It is not even necessary to wait for the investigation and court proceeding. Yoon acknowledged his guilt, and hurried back to Korea!" That is the message that Lee formulated and delivered to the president, and also to the world. (To be beefed up further with more events and details as need arise)
